THIS IS THE LAST WILL AND TESTAMENT
MERRIEL BOLAM of Holbrook Grange Rugby Widow
- I REVOKE all testamentary instruments heretofore made by me.
- I APPOINT my great nephew CAPTAIN GUY RANDOLPH WESTMACOTT D.B.O., M.C. and my friend MRS GWENDOLINE MARY OLIVER-BELLASIS of Shelton House near Coventry TRUSTEES and EXECUTRIX of this my Will and I BEQUEATH to each of them who shall prove this my Will the sum of Fifty pounds free of duty for his or her trouble.
- I MAKE the following specific bequests all free of duty :-
TO my Sister Eleanor Caldecott my small flat shaped silver Tea Pot with modern sugar basin and cream jug in case and silver cow milk jug.
TO the said Mrs Gwendoline Mary Oliver-Bellasis my oblong mirror said to be Hepplewhite in a narrow black frame with a gold pattern on it now in the Dining Room at Holbrook and all my clothes and furs and sundry other effects which I have names in a list and handed to her knowing (but without imposing any legal or binding trust or obligation upon her) that she will carry out my wishes with regard to them.
TO my Sister Eleanor Caldecott my pair of hair bracelets with diamond and small pearl clasps My Maltese Cross Brooch of diamonds and small pearls My single stone diamond ring My pearl ring and all other trinkets Jewellery and ornaments of the person (except those bequeathed to Mrs Oliver-Bellasis)
TO Mrs Beatrice Graham and old mahogany Chippendale Armchair with a cretonne seat now in the Drawing Room at Holbrook as well as my black leather Dispatch Box with Brahms lock left to me by my Husband with gilt initials C.G.B.
TO the said Captain Guy Randolph Westmacott my household furniture silver plate plated articles and all other articles of domestic or household use or ornament in or used in connection with my said house Holbrook Grange (with the exception of the bequests in the list given to Mrs Oliver-Bellasis) all outdoor effects and the shoe buckles worn by Abraham Caldecott his Great Grandfather of the Lodge Rugby High Sheriff of the County of Warwick for the year One thousand eight hundred and twenty one at the Coronation of King George the Fourth at Westminster Hall on July nineteenth of that year.
- I BEQUEATH the following pecuniary legacies all free of duty :-
TO my Niece Frances Margaret Cochran Two thousand pounds
TO my Niece Caroline Mary Ridding Four Hundred pounds
TO my Niece Emily Charlotte Ridding Three hundred pounds
TO my nephew Paul John Cochran One hundred pounds
TO my nephew Herman Randolph Purves Cochran One thousand pounds.
TO Mrs Amy Chivers Marriott Four hundred pounds but if she shall not be living at my death I bequeath the same sum to her son Richard Wharton Marriott.
TO my Cousin Esther Marriott Fifty pounds.
TO Mrs Mary Beatrice Crosthwaite of Catthorpe near Rugby Fifty pounds.
TO the Reverend Robert Harvey Baldwin Crosthwaite the husband of the said Mary Beatrice Crosthwaite Three hundred pounds but is he shall not be living at my death I bequeath the same sum to his said Wife in addition to the sum of Fifty pounds.
TO George Charles Allen Junior of Peninsular Farm Newbold-on-Avon One hundred pounds.
TO the said Gwendoline Mary Oliver-Bellasis Two hundred and fifty pounds in addition to the sum of Fifty pounds she will received if she proves this my Will and
TO her Husband Captain Oliver-Bellasis Fifty pounds.
TO my friend Dr Bernard Relton Two hundred pounds
TO Harry Bolam son of my late Brother-in-law William Bolam Two hundred pounds.
TO my step-daughter Kathleen Bolam Fifty pounds
TO Miss Emma Sarah Spokes Twenty five pounds
- I BEQUEATH the following annuities all free of duty to be paid quarterly the first payment to be made at the expiration of three calendar months after my death AND I DIRECT my Trustees to appropriate in their names a fund in any authorised trust investments sufficient at the time of appropriation to answer by the annual income thereof the payment of such annuities and in the meantime to pay such annuities out of the monies to arise from my residuary real and personal estate hereinafter devised and bequeathed but such annuities shall after such appropriation as aforesaid be payable out of the appropriated fund exclusively in exoneration of any other estate PROVIDED That if the income of the appropriated fund shall at any time be insufficient to satisfy the said annuities my Trustees may resort to capital to make good any deficiency Such fund shall subject to the payment of such annuities form part of my residuary personal estate TO my Housekeeper Mrs Augusta Oldham Eighty pounds for her life such annuity to be continued to her Husband Thomas Oldham for his life should he survive her TO my parlourmaid Theresa Godwin Twenty six pounds for her life and TO Robert Lewis Finson Twenty six pounds for his life payable weekly or at such other times as my Trustees shall decide and after his death if she shall survive him to his wife Edith Finson.
- IF he shall comply with the direction as to name continued in Clause 7 hereof I DEVISE AND BEQUEATH to the said Captain Guy Randolph Westmacott absolutely but if he shall predecease me or fail to comply with the said direction then to Richard Victor Charles Westmacott absolutely if he shall survive me and attain the age of twenty three and comply with the said direction and failing his attaining the age of twenty three or complying with the said direction then to Ian Victor Westmacott provided he shall comply with the said direction. Firstly ALL that parcel of land called “the Little Close” situate in the Hamlet of Long Lawford in the County of Warwick surrounding the site of the Chapel of Ease of St. John Secondly All that small piece of garden ground by the Burial Ground also in the Hamlet of Long Lawford formerly in the occupation of Mr Horace Dunkley Thirdly All that piece of garden ground also in the Hamlet of Long Lawford now in the occupation of Mr James Baxter and Fourthly my estate known as Holbrook Grange Estate consisting of Holbrook Grange cottages and about One hundred and forty acres of land AND I DESIRE to express the strongest wish that during the lifetime of the Reverend George Bridgman Fanshaw Boughton Leigh the said Holbrook Grange Estate shall not be sold AND I trust absolutely to the honour of the Owner not to sell it I also desire here to record that the South Aisle of the church of St Boughton [should read Botolph – mistyped on original] Newbold-on-Avon forms part of the Holbrook Grange Estate the owner of which is responsible for the repair and maintenance It was restored early in the nineteenth century by Mr John Caldecott and in the present century in the years One thousand nine hundred and five and One thousand nine hundred and six by my Brother Colonel Caldecott And fifthly All the residue of my real and personal estate.
- I HEREBY DIRECT AND DECLARE that the said Captain Guy Randolph Westmacott or if he shall predecease me or fail to comply with the direction contained in this clause the said Richard Victor Charles Westmacott if he shall predecease me or die under the age of twenty three years or fail to comply with the direction contained in this clause the said Ian Victor Westmacott shall within six calendar months next after my death of in the case of the said Richard Victor Charles Westmacott or the said Ian Victor Westmacott within six months after attaining twenty three take upon himself the addition surname of Caldecott which shall stand last in the surname videlicit Westmacott Caldecott and shall determine thenceforth to style and write himself in all letters deeds and instruments and upon all occasions whatsoever by that surname.
- IF the trusts hereinbefore contained in favour of Captain Guy Randolph Westmacott the said Richard Victor Charles Westmacott and the said Ian Victor Westmacott shall fail then I DEVISE AND BEQUEATH all the residue of my real and personal estate to the Grandson of my old friend and contemporary the late Mrs Emma Woollcombe Adams of Anstey Hall Coventry John Oliver-Bellasis (Royal Fusiliers) absolutely and I DIRECT AND DECLARE that the said John Oliver-Bellasis shall take upon himself the additional name of Caldecott which name shall stand last in the surname videlicit Bellasis -Caldecott PROVIDED that if the said Captain Guy Randolph Westmacott shall survive me but fail to comply with the said direction contained in clause 7 hereof so that the devise and bequest in his favour shall not take effect then I REVOKE the appointment of the said Captain Guy Randolph Westmacott to be a Trustee of this my Will jointly with the said Mrs Gwendoline Mary Oliver Bellasis and in that case I bequeath him a legacy of Fifty pounds free of duty if he shall prove this my Will AND provided that my ? in the said Captain Guy Randolph Westmacott the said Richard Victor Charles Westmacott nor the said Ian Victor Westmacott ???? Said Holbrook Estate upon I BEQUEATH to the said Captain Guy Randolph Westmacott legacy free of duty of Eight Hundred Pounds to compensate him for what he spent in laying out a bridge and repairing the road at Holbrook.

I BEQUEATH the picture of Thomas Caldecott Calthorpe Hall Leicestershire High Sheriff of the County of Leicester in 1664-1665 and the two small oval pictures in gold frames of William Caldecott father of Abraham Caldecott and of his wife Anna all now at Holbrook to Captain Guy Randolph Westmacott free of duty.
I BEQUEATH to my sister Eleanor Caldecott my pendant of Brazilian crystal and small brooch to match free of duty

THIS IS A CODICIL to the last Will and Testament of me MERRIAL BOLAM of Holbrook Grange Rugby in the County of Warwick Widow which Will bears date the Eleventh day of October One thousand nine hundred and thirty four WHEREAS by Clause 5 of my said Will I have bequeathed an annuity of Eight Pounds free of duty to my Housekeeper Mrs Augusta Oldham for her life such annuity to be continued to her Husband Thomas Oldham for his life should he survive her NOW I HEREBY REVOKE the said bequest of the said annuity of Eighty Pounds and in lieu thereof I BEQUEATH free of duty an annuity of FIFTY TWO POUNDS to my said Housekeeper Mrs Augusta Oldham for her life such annuity to be continued to her Husband Thomas Oldham for his life should he survive her AND I DECLARE that all the powers and provisions contained in my said Will as to the payment or annuities and the appropriation of an Annuity Fund shall apply to the said annuity of Fifty two pounds hereby bequeathed to Mrs Augusta Oldham and her Husband Thomas Oldham if he should survive her AND in all other respects I confirm my said Will.

This is a Third Codicil to the last Will of me MERRIEL BOLAM of Holbrook Grange Rugby which Will bears date the eleventh day of October one thousand nine hundred and thirty four and the two previous Codicils thereto the twenty eighth day of June one thousand nine hundred and thirty five and the fourteenth day of January one thousand nine hundred and thirty five respectively.
WHEREAS BY Clause 4 of my said Will I BEQUEATH a pecuniary legacy free of duty of Twenty five pounds to Miss Emma Sarah Spokes I now revoke this legacy
WHEREAS by Clause 5 of my said Will I BEQUEATH annuities of Twenty six pounds to each of them my parlourmaid Theresa Godwin and Robert Lewis Finson I NOW BEQUEATH to each of them the said Theresa Godwin and Robert Lewis Finson an annuity of Fifty two pounds payable in each case in the same manner and on the same terms as declared by me in Clause 5 of my said Will AND IF HEREBY REVOKE the legacy of Two hundred pounds dated the Fourteenth day of January One thousand nine hundred and thirty five and DECLARED that the annuity hereinbefore bequeathed to the said Theresa Godwin is in substitution for the said legacy of Two hundred pounds bequeathed by my said Codicil dated the Fourteenth day of January One thousand nine hundred and thirty five
IN all other respects I confirm my said Will and the two previous Codicils thereto

- I DIRECT that the said Sir Bernard Edward Halsey Bircham shall be entitled to make all usual professional and other charges for work done by him or his firm in connection with my said Will and Codicils and the trusts thereof notwithstanding he is a trustee thereof

THIS IS A FOURTEENTH CODICIL to the last Will of me MERRIEL BOLAM of Holbrook Grange Rugby Widow which Will bears date the Eleventh day of October One thousand nine hundred and thirty four WHEREAS by a third codicil to my said Will which said third codicil bears date the Thirtieth day of August One thousand nine hundred and thirty five I BEQUEATH to my parlourmaid Theresa Godwin an annuity of Fifty two pounds I now CONFIRM such annuity and in addition thereto I now BEQUEATH to the said Theresa Godwin a legacy of Fifty pounds free of duty In all other respects I confirm my said Will and previous codicils.

THIS IS A SIXTEENTH CODICIL to the Will of me MERRIEL BOLAM of Holbrook Grange near Rugby which Will bears date the eleventh day of October One thousand nine hundred and thirty four I BEQUEATH a sum of Fifty pounds free of duty to my Gardener William Thornton and the use of his present cottage for three months after my death if he shall still be in my service at my death and not under notice to leave either given or received. I ALSO BEQUEATH free of duty to my parlourmaid Teresa Godwin if she shall still be in my service at my death and not under notice to leave either given or received the following bedroom furniture (now in my bedroom) black and brass single bedstead mattress bolster and pillow coloured bed-quilt two blankets and underblanket small marble topped washstand with cupboard mahogany chest of drawers with drop down lid green serge curtains for dress-hanger grey-green hearth rug green carpet fender and fire irons two cotton sheets bed-spread polished mahogany table used as a dressing table with looking glass washstand set and pail old inlaid writing cabinet with drop down lid and drawer shelves above and cupboard beneath fitted with two locks and key IN all other respects I confirm my said Will and the Codicils thereto

- WHEREAS by a third codicil dated the thirtieth day of August One thousand nine hundred and thirty five to my said Will I bequeath an annuity of Fifty two pounds to my parlourmaid Theresa Godwin I NOW REVOKE such annuity and BEQUEATH in lieu thereof an annuity of TWENTY SIX POUNDS to the said Theresa Godwin to be paid in the same manner end upon the same terms as declared by me in Clause 5 of my said Will

- WHEREAS by a seventeenth codicil dated the eighth day of August One thousand nine hundred and thirty eight I bequeath an annuity of Twenty six pounds to my parlourmaid Theresa Godwin I NOW REVOKE such annuity and BEQUEATH in lieu thereof an annuity of Fifty two pounds to the said Theresa Godwin to be paid in the same manner and upon the same terms as declared by me in Clause 5 of my said will
- I CONFIRM the legacies bequeathed to the said Theresa Godwin by a sixteenth codicil dated the twenty second day of June One thousand nine hundred and thirty eight to my said Will and DECLARE that the said Theresa Godwin shall be entitle to such legacies whether or no she be still in my service of under notice to leave either given or received at my death

THIS IS A TWENTY FIRST CODICIL to the last Will of me, MERRIAL BOLAM of Holbrook Grange Rugby Widow which Will bears date the eleventh day of October One thousand nine hundred and thirty four WHEREAS I bequeath to my nephew Paul John Cochran by my said Will a legacy of One hundred pounds free of duty by an eighth Codicil thereto dated the thirteenth day of January One thousand nine hundred and thirty seven an additional legacy of One thousand pounds free of duty, by an eleventh Codicil thereto dated the eighteenth day of June One thousand nine hundred and thirty seven an additional sum of fifty pounds and by a thirteenth Codicil thereto dated the twenty fourth day of August One thousand nine hundred and thirty seven an additional legacy of Eight hundred and fifty pounds free of duty and therein expressed as making a total sum of Two thousand pounds free of duty AND WHEREAS by a twentieth Codicil to my said Will which said twentieth Codicil bears date the third day of January One thousand nine hundred and thirty nine I bequeath to my said nephew a further sum of two hundred pounds free of duty in addition to the said legacies amounting to the total sum of Two thousand pounds free of duty I NOW REVOKE the said legacies amounting to the total sum of Two thousand pounds free of duty and I NOW BEQUEATH the sum of Two thousand pounds free of duty to my Trustees to hold the same upon trust for my said nephew Paul John Cochran during his life and after his death in trust as to both capital and income for my nephew Herman Randolph Purves Cochran absolutely And subject hereto and if my said nephew Herman Randolph Purves Cochran dies in my lifetime leaving issue living at my death I BEQUEATH the said Two thousand pounds to my Trustees In trust (always subject to the life interest of the said Paul John Cochran) for all or any of the children or child of the said Herman Randolph Purves Cochran who attain the age of twenty one years or being daughter marry under that age and if more than one in equal shares And if no child of the said Herman Randolph Purves Cochran attains a vested interest in the said legacy the same shall fall into and form part of residuary estate I HEREBY CONFIRM the legacy of Two hundred pounds free of duty to my said nephew Paul John Cochran which I bequeath in my twentieth Codicil and in all other respects I CONFIRM my said Will and the twenty previous Codicils thereto

THIS IS A TWENTYSECOND CODICIL to the last Will of me MERRIEL BOLAM of Holbrook Grange Rugby which Will bears date the eleventh day of October One thousand nine hundred and thirty four I BEQUEATH to my niece free of duty namely Miss Maria Caldecott of Viamonte 159 Cordoba Argentina South America the sum of Two hundred pounds Inasmuch as my personal estate may not be quite sufficient to pay all the legacies bequeathed by my Will and the Codicils thereto NOW I HEREBY DIRECT that any surplus that may be required to satisfy these legacies shall be provided by and shall by charge upon the Holbrook Grange estate which by my said Will is therein devised to Captain Guy Randolph Westmacott and others IN all other respects I confirm my said Will and the various codicils thereto

THIS IS A CODICIL to the last Will of me MERRIEL BOLAM of Holbrook Grange Rugby Widow which Will bears date the Eleventh day of October One thousand nine hundred and thirty four WHEREAS by Clauses 6 7 and 8 of my said Will I have made certain devizes and bequests of my real estate and the residue of my personal estate unto and on behalf of my nephew Major Guy Randolph Westmacott and his children NOW I HEREBY REVOKE the gift of the residue of my real and personal estate thereby made and in lieu thereof I DEVISE AND BEQUEATH the residue of my real and personal estate as follows:- One third equal part thereof to so to the said Major Guy Randolph Westmacott a further one third equal part thereof to so to Paul the son of Herman Purves Cochran and the remaining one third equal part thereof to so to Thomas the other son of Herman Purves Cochran AND I DIRECT that if any of the three of them the said Guy Randolph Westmacott Paul Cochran and Thomas Cochran shall predecease me then the share of my estate so directed to be paid to them shall be paid in place thereof to the eldest son of any of them who shall survive my end if any one of the said three shall predecease me without leaving a son him surviving then I DIRECT that the share of the one so dying shall go to increase the share of the survivors of them IN all other respects I confirm my said Will and the Codicils thereto
